Terms of Service

The rules that apply when you use Kiwisonic and this website.

These terms govern your use of the Kiwisonic website and the Kiwisonic desktop application. By using either, you agree to these terms. If you do not agree, do not use the service.

1. The service

Kiwisonic is a desktop composition application for Windows. The website offers product information, documentation, early access registration, and feature suggestions. The service is provided by Kiwisonic.

2. License

When you purchase Kiwisonic, you receive a personal, non-transferable, perpetual license to use the version you purchased. The license is for one user. You may install the software on your own computers for personal use.

You may not:

  • Redistribute, sublicense, or resell the software or your license key.
  • Reverse engineer, decompile, or disassemble the software beyond what applicable law permits.
  • Remove or alter any copyright or license notices in the software.

Music and compositions you create with Kiwisonic are entirely yours. We make no claim to your creative output.

3. Major version upgrades

Your license covers the major version you purchased. Updates and bug fixes within that version are included. Major version upgrades (for example, from v1 to v2) are sold separately.

4. Early access and the early bird offer

Early access gives you the right to use pre-release builds of Kiwisonic. Pre-release software may be incomplete, contain bugs, or change significantly before the final release. We do not guarantee stability or feature completeness in pre-release builds.

The early bird offer reserves your discounted price. No payment is taken at registration. The discounted price is only valid during the purchase window we notify you of.

5. Right of withdrawal (EU consumers)

If you are a consumer in the European Union, you have the right to withdraw from a digital purchase within 14 days without giving a reason, as long as you have not started downloading or activating the software.

By starting the download or activating your license, you expressly consent to the immediate supply of the digital content and acknowledge that your right of withdrawal ceases at that point, in accordance with Article 16(m) of Directive 2011/83/EU.

6. Availability and changes

We may change, suspend, or discontinue any part of the website or service at any time. We will give reasonable notice when possible. Discontinuation of the website does not affect your right to use software you have already purchased.

7. Accounts

You are responsible for keeping your login details secure. Do not share your account. If you suspect unauthorised access to your account, contact us immediately.

8. User content

If you submit feature suggestions through the website, you grant us a non-exclusive, royalty-free right to use that feedback to develop the product. We will not publish your suggestions under your name without your consent.

9. Limitation of liability

To the maximum extent permitted by applicable law, Kiwisonic is not liable for indirect, incidental, or consequential damages arising from your use of the software or website. Our total liability for any claim arising under these terms is limited to the amount you paid for the software.

Nothing in these terms limits our liability for death, personal injury, or fraud caused by our negligence, or any statutory rights you have as a consumer that cannot be excluded by contract.

10. Warranties

We warrant that the software will perform materially as described in the documentation for 90 days from purchase. If it does not, contact us and we will repair or replace it, or provide a refund.

If you are a consumer in the EU, you may also have statutory warranty rights under applicable national law that are additional to and independent of this warranty.

11. Governing law

These terms are governed by Swedish law. Disputes are subject to the jurisdiction of the Swedish courts, except where mandatory consumer protection rules in your country of residence give you the right to bring claims in your local courts.

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to these terms

We may update these terms from time to time. Material changes will be notified by updating the date at the top of this page. Continued use after the effective date means you accept the updated terms.
